New Regulation on Private Employment Agencies

Article 7 of the Labor Law dated 22.05.2003 and numbered 4857 was enacted by the TBMM with Law No. 6715 on dated 06.05.2016. The relevant law has been changed as follows.

With this law, a temporary employment contract will be signed between Private Employment Agencies and employers and their transfer to employers will be provided.

ARTICLE 7 - Temporary work relationship can be established through a private employment agency or by assigning a job within the holding or another workplace affiliated with the same group of companies.

Through the private employment agency, temporary work relationship, which is permitted by Türkiye Business Authority, can be established by making contract to delegate the temporary worker with an employer of private employment offices;

  1. In the cases specified in the fifth paragraph of Article 13 and Article 74 of this Law, in case of military service of the worker and in other cases where the employment contract is suspended,
  2. In seasonal agricultural work,
  3. In household services,
  4. In jobs that are not considered as daily work of the business and that are performed intermittently
  5. In the works that are urgent in terms of occupational health and safety or in case of compelling reasons that significantly affect the production,
  6. In the case of an unforeseen increase in the average production capacity of goods and services to the extent that the business requires the establishment of a temporary business relationship
  7. In case of periodic job increases excluding seasonal jobs
