Presidential Decree on Increasing the Minimum Capital Amount for Joint Stock and Limited Liability Companies Has Been Published

With the Presidential Decree numbered 7887 published in the Official Gazette dated November 25, 2023 Saturday and numbered 32380, it was decided to put into effect the decision on increasing the minimum capital amount for joint stock and limited liability companies.

Regulation on Electronic Commerce Intermediary Service Provider and Electronic Commerce Service Provider

Regulation on Electronic Commerce Intermediary Service Provider and Electronic Commerce Service Providers ("Regulation")for the audits of electronic commerce intermediary service providers and electronic commerce service providers and commercial relations between them has been published in the Official Gazette numbered 32058 and dated December 29, 2022.

The issues regulated by the Regulation are as follows:

1- Obligation to Provide Information

The Regulation defines "electronic commerce service provider" ("ETHS") and "electronic commerce intermediary service provider" ("ETAHS").

Accordingly, ETHS and ETAHS are obliged to have the information specified in the Regulation under the title of communication in their own electronic commerce environment.

2- Order Obligations

ETHS and ETAHS in electronic environment, the obligation is imposed to provide technical tools such as the sale of second hand article in a separate category, the submission of issues related to price and delivery and tax costs before entering payment information, and the provision of technical tools such as ‘return' with summary order form before the order is approved.

Communiqué for Amendment of the Communiqué on Article 376 of the Turkish Commercial Code

Communiqué on the Amendment of the Communiqué on the Procedures and Principles for the Implementation of the Article 376 of the Turkish Commercial Code Numbered 6102 ("Amendment Communique") (In Turkish) has been published in the Official Gazette dated November 8, 2022 and numbered 32007. The amendment made in the Communique is as follows;

With the Amendment Communiqué, published in the Official Gazette dated September 15, 2018 and numbered 30536, the provisional clause of "Communiqué on the Procedures and Principles for the Implementation of the Article 376 of the Turkish Commercial Code Numbered 6102” ("Communiqué") (In Turkish)

Regulation on Consumer Arbitration Committees Has Been Published

1) What is Consumer Arbitration Committee?

Consumer arbitration committees are the institutions that conclude disputes related to consumer transactions and are established to find solutions to disputes that may arise from consumer transactions and consumer-oriented practices.

2) What are the Fundamental Regulations Made in the Regulation on Consumer Arbitration Committees?

With the relevant Regulation, the old regulation was abolished, and the working procedures and principles of the consumer arbitration committees and the procedures and principles related to process and transactions were generally determined.

The Regulation on Consumer Arbitration Committees ("Regulation") (In Turkish) has been published in the Official Gazette dated September 21, 2022 and numbered 31960. The regulations made in the Regulation are as follows;
