New Restrictions and Measures - December 2020

The President announced a Circular on Curfews and New Circular on Restrictions and Measures on 30.11.2020.

As per that Circular; until a new decision is taken, a curfew will be applied across the country on weekends; starting at 21:00 on Fridays, covering all Saturday and Sunday and ending at 05:00 on Mondays.

The first application will start at 21:00 on Friday, 04.12.2020 and end at 05.00 on Monday, 07.12.2020.

In addition, until a new decision is taken, a curfew will be restricted between 21:00 and 05:00 on weekdays (Monday, Tuesday, Wednesday, Thursday and Friday) throughout the country.

The first application will start at 21:00 on Tuesday, 01.12.2020 and end at 05.00 on Wednesday, 02.12.2020.

Also; during the curfew, certain places and persons will be exempted from the restriction in order to ensure the continuity of production, manufacturing, supply and logistics chains and the continuity of health, agriculture and forestry activities.

As per these decisions, the below will be exempt from these restrictions.

New Regulations on Employment Incentives & Debt Structuring

New regulations came into force for employers and employees with the Law No. 7256 published in the Official Gazette, dated 17 Nov 2020, numbered 31307.

Important Points Regarding the Additional Employment Incentives as per the New Regulation

For those who benefit from unemployment benefits, long-term insurance premiums to be calculated for the period they benefit from the unemployment benefit will be covered by the Unemployment Insurance Fund, if they are employed within 90 days following their termination, work subject to uninterrupted service contract for 12 months and make a request.

The President has been authorized to extend the Employment Incentive practice of Young, Women and those with professional certificates until 31/12/2023.

The President has been authorized to extend the additional employment support in the provisional article 19 of the Unemployment Insurance Law until 31/12/2023.

The President has been authorized to extend the income tax withholding incentive and stamp tax support provided to private sector employers who provide additional employment in accordance with Law No. 7103 until 31/12/2023.

The effective date of the Tradesmen's ahi-order Fund application has been changed as 31/12/2023.

Decisions of Istanbul Public Health Board - November 2020

Istanbul Public Health Board has announced new measures on 04.11.2020 for Covid-19.

As per these decisions, the following workplaces should be closed at 22:00, the latest:

  • Restaurants, cafes, patisseries except deliverers,
  • Coffeeshops,
  • Barbers, coiffeurs,
  • Wedding ceremony halls,
  • Sport centers,
  • Internet cafes, game centers,
  • Theatres, cinemas, concert halls,
  • Swimming pools, etc. places.

2021 Mandatory Private Pension Obligation

As known, with the "Regulation on the Amendment of the Regulation on the Procedures and Principles Regarding the Automatic Enrollment of Employees in the Pension Plan Through Their Employers", which entered into force on 7.12.2018, the points that employers should pay attention to in mandatory individual pension processes were explained.

According to these points, employers may have some obligations regarding automatic private pension plans as of 2021. (There is no need for any additional processing for employers who were previously included in the scope of Mandatory Private Pension Plan - automatic enrollment. These employers will continue their current Mandatory Private Pension Plans.)
