2017 Legal Parameter Changes

Income Tax Exempted Food Allowance

Meal allowance tax exemption amount that is applied as of 1st January 2017 was announced in 296 serial numbered Income Tax General Communique on 27.12.2016 with Official Gazette. According to this announcement, meal allowance, which is provided by the employer outside of the workplace and workplace outbuildings as defined in the Income Tax Law's 23rd Articles, exemption amount is defined as 14.00 TL for 2017.

New Amendment on Establishing A New Company in Türkiye Announced

Ministry of Customs and Trade has declared a revision on company establishment procedures to fasten the establishment processes since preparing the necessary documents regarding the establishment process requires great amount of time and creates great costs. With the announcement being made on December 12, 2016 on the Official Gazette, the amendment made by the Ministry of Customs and Trade has gone in effect.

The Social Security Institution (SSI) Cap Coefficient Has Been Changed

The Law on Amendments to the Public Fiscal Administration and Control numbered 6761 and other regarding regulations have come in force upon its publication in the Official Gazette numbered 259898 issued on November 24, 2016.

As stated in the Article 8 of the 6761 numbered Law and the term “6.5 times” mentioned in the Article 82 of the Law no. 5510 on Social Insurances and General Health Insurance Law no 5510 (enacted on May 31, .2016) has been re-evaluated and changed to “7.5 times”.

New Regulation on Part Time Employment Has Been Announced

It has been announced in the Official Gazette numbered 29620 dated February 10, 2016 employees were given the right to unpaid leave and/or part time working hours after childbirth and/or adoption of a child under the age of three, with the changes made in the 13th and 74th Articles of the Labor Law numbered 4857 and Law numbered 6663.

In November 11, 2016, dated Official Gazette, it has been announced from the Ministry of Labor and Social Security that with the new regulations being put in effect, employees whom benefit from maternity leave and/or unpaid leave in regards can require part time working hours until the beginning of the month of the child/children starts his/her primary education.
